State-by-state student data privacy
Ed.ai complies with FERPA and COPPA nationally, and adapts to each state's requirements through the NDPA v2.1 with General Offer.
We cover all US states through two layers:
Federal baseline — applies everywhere: FERPA + COPPA + our own commitments (US hosting, no model training on student work, no advertising, human-in-the-loop grading).
NDPA v2.1 + Exhibit E (General Offer) — contractually adapts the federal baseline to a state's statutory requirements wherever a district adopts it. Where a state requires additional clauses, we attach the applicable state addendum.
Get your state's data privacy packet — the NDPA v2.1 (pre-signed, General Offer) plus the relevant state addendum — at ed.ai/en/forms/data-privacy. Email privacy@ed.ai to confirm coverage for your jurisdiction.
State student privacy law moves fast. We monitor changes in state student privacy and AI law and adapt our practices and contracts as new requirements take effect.
For RFP responses or a district privacy review, email privacy@ed.ai with your state and district. We'll attach the relevant state addendum to any NDPA signature.
